第三節 國際勞工組織公約於國際法上之性質
國際勞工組織為聯合國大會所轄經濟社會理事會（ECOSOC)下之專門機構，而國際勞工組織之公約基本上具有國際法上之性質，國際法經過不斷演進及各國實踐發展出普遍認可之法律。
依國際勞工組織憲章之規定，批准的任何公約，應由國際勞工局局長送交聯合國秘書長按照聯合國憲章之規定登記，當憲章發生效力後，聯合國任何會員國所締結之一切條約及國際協定應儘速在秘書處登記及公布。在聯合國憲章義務優先的規定下，國際勞工組織公約應具有勞動基本人權之普世價值，不論是否具有聯合國或國際勞工組織會員國資格；是否批准公約，對每個國家或政治實體等均有拘束力。
第一項 國際法與國際組織之關係
國際法包括國際公法與私法，國際公法係以國家主權及國際組織為表徵，以國家公權力作用，形成其在國際舞台上之特殊地位。由於國際社會不斷發展，基於技術性及現實性之需要，現今國際公法已發展形成嶄新之特別法，如國際經濟法、國際貿易法、國際人權法、國際環境法等。目前聯合國負責聯繫全世界各種的國際組織，國際組織在國際法中扮演了重要角色，對國際法的發展有重大影響與貢獻。
一、國際法的法律性質
法學界有一種被廣泛接受的理論，認為國際法不是真正的法律，僅是具有道德力量的行為規則而已，英國法理學學家奧斯丁(John Austin)便被公認是這種理論的先驅，其他懷疑國際法之真正合法性質的學者，還有英國學者霍布斯(Thomas Hobbes)、海德堡大學教授蒲芬多夫(Samuel Pufendorf)、邊沁 (Jeremy Bentham)。根據奧斯汀的理論，法律乃是來自一個具有明確主權的合法權威當局的命令。邏輯上，如果這套規則最終不是來自一個具政治優勢的主權當局，或是根本不存在著主權權威，那他們就不是合法規則，而只是具有道德或倫理的效力而已。若將這個普遍理論適用於國際法，既然在國際社會中並沒有具有合法權力，或實際上具有絕對力量之明顯權威存在，而在他那年代裡，國際法又幾乎全是慣例，因此斷定國際法並非真正的法律(true law)。【83】 在這種理論下，國際法當然不能被認為是法律。因此，他認為國際法只是「實證道德」(Positive morality)。勞特派特修改的奧本海國際法中認為法律的要件有：
(一)必須有一個社會的存在。
(二)在這社會裡必須有一套規則來規律社會中各分子間的關係。
(三)這個社會共同認為得以外力來執行法律(制裁)。
如果以這三個要件來衡量國際法，它確實具備法律的要件，不過與國內法比較，國際法的制裁力較弱；它沒有一個中央集權的執法機構，但也不是完全沒有中央集權的制裁，例如在聯合國制度下的集體干涉，就是一種制裁的方法。儘管我們認為國際法是法律，但同時應了解，它在立法及司法軌行方面均不如國內法完備，是一種「弱法」(weak law)。【84】
國際法經過不斷演進及各國實踐發展出普遍認可之法律，包括國際公法與私法，國際實體法與程序法，狹義國際法，乃專指國際公法，在法律領域中，真正含國際性之法律，唯有國際公法始足以當之，國際公法係明顯以國家主權及國際組織為表徵，以國家公權力作用，形成其在國際舞台上之特殊地位。【85】
二、國際法的法源
國際法的法源可分為初級法源及次級法源。初級法源包括習慣法、條約法及一般法律原則；次級法源包括國際組織的內部法及裁判。形成國際組織的條約(規約)通常規定其機關得訂定各種規範，即國際組織的內部法規。而國際司法及仲裁機構則亦可基於條約及其他規定而為裁判。由於國際法之各種法源漸形完備，致國際法亦形成一套較為完整的法律秩序。奧地利國際法學家（Alfred Verdross）則把國際法中之一些基本性的規定，不論其是由不拘形式之合意而產生者或者是習價法或條約法或一般法律原則，歸納為國際法憲章，以別於其他國際法之規定。【86】
由於國際社會不斷發展，基於技術性及現實性之需要，傳統一般性之國際公法，已無法因應，務創制具體專門法律，以規範新事實。昔日僅屬國際公法下之基本問題、或事項，今已形成嶄新之特別法，如「國際經濟法」、「國際貿易法」、「國際人權法」、「國際環境法」等，其重要性與日俱增，範圍擴大。與國際組織相互結合，另形成特殊結構與關係，其現象遠非一般國際公法之法理原則所可解釋與適用。【87】
三、國際組織(International Organization)
國際組織是指國家間根據條約所組成的團體以追求共同目標，並且該團體有特別機關來執行該組織的任務，【88】 亦稱為政府間組織(Inter-governmental organization)。
國際組織之條約必須要經過批准手續，並且要經所有或一定數目的簽字國批准才能生效。生效後，其他非締約國可以根據該條約規定的方式加入該國際組織。國際組織的出現是由於國家間關係日益密切，除了透過雙邊或多邊會議來解決共同關切的問題外，各國在各方面需要合作的事項更多，因此國際組織大量出現，但都是對特定事項或功能而成立的組織，1920年成立目的與功能廣泛的世界性國際組織，就是國際聯盟(League of Nations)，1946年此組織解散，由聯合國(United Nations)取代，聯合國並負責聯繫全世界各式各樣的國際組織。國際組織在國際法中扮演了重要角色，對國際法的發展也有重大影響與貢獻。【89】
四、國際法的一般法律原則
依據國際法院規約第38條規定：「一般法律原則為文明國家所承認（The general principles of law recognized by civilized nations）」。主要包括：一般正義原則（General principles of justice）；自然法；自私法方面的比擬（Analogies derived from private law）；比較法的一般原則；國際法的一般原則；法律的一般理論（General theories of law）；一般的法律概念（General legal concepts）。【90】 例如，特別法優於普通法（A special law prevails over a general law）、後法優於前法（A later law repeals an earlier law）。【91】
第二項 國際勞工組織公約於國際法之性質
國際勞工組織在聯合國成立以前就存在，而與國際聯盟有聯繫但保持自主性，1946年12月14日成為聯合國第一個專門機構。【92】 國際勞工組織大會通過的議案有兩種方式：國際公約(Conventions)；建議書(Recommendations)，是對某一個問題被認為不適宜訂立在公約中。不論公約或建議書，需要出席代表三分之二的通過。【93】 由於勞工或僱主的代表均可以獨立投票，不受政府代表的指揮，所以公約通過後，不由政府代表簽署，而只由大會主席和國際勞工局局長簽字確認。公約通過後，就送交會員國批准，如果是建議書，則送交會員國考慮以便使用國家立法或其他方法予以實施。每個會員國不論其政府代表投票贊成或反對該議案，必須在一年或最多一年半將公約或建議向主管該項事務的國家當局(通常是立法機關)提出，以制定法律或採取其他行動。對於未批准某一公約的會員國，該國也應照理事會的要求，在適當時間將有關公約所規定事項的本國法律和實踐的情況報告給國際勞工長局長。這種報告應說明妨礙或延遲公約批准的困難情形，對於建議會員國有類似義務。【94】
公約批准後，每年批准國必須對適用公約的情況提出報告，並須將報告送交勞工與僱主團體。然後由一個專家委員會來評估這些報告，並由三方代表團體來檢視個別遵行的情形。【95】 個別的勞工或僱主團體可以向國際勞工局申訴政府未遵守公約的情形。【96】 其他批准公約的國家也可以控訴其他批准國未遵守的情形。【97】 然後由一個調查委員會(Commission of Inquiry)來調查事實與提出建議送交理事會，如有關國家不接受報告，可以將爭執提交國際法院（International Court of Justice）作最後的裁決。【98】 依國際勞工組織憲章第20條規定：「批准的任何公約，應由國際勞工局局長送交聯合國秘書長按照聯合國憲章（Charter of the United Nations）第102條的規定登記，但它只對批准公約的會員國有拘束力」；【99】 聯合國憲章第102條規定：「本憲章發生效力後，聯合國任何會員國所締結之一切條約及國際協定應儘速在秘書處登記，並由秘書處公布之」；【100】 聯合國憲章第103條規定：「聯合國會員國在本憲章下之義務與其依任何其他國際協定所負之義務有衝突時，其在本憲章下之義務應居優先」。
